A Sr 22 Form is a form used by your states drivers license facility to help you show proof of insurance. Usually your insurance company just send a bond directly to your secretary of state or DMV with your state and they keep this on fill showing you have and open policy with that insurance company. SR22 may also be know by Financial Responsibility insurance.

That’s a good question. This is something you can’t do by yourself. You probably need your parents’ or guardians’ permission and help. Here’s what you can do:

If your driver license has not expired, you will need to:

* Pay a $55 reissue fee.
* Provide proof of insurance (SR 22). You must maintain this insurance for 3 years.

If your driver license has expired or your driving privilege was revoked, you will need to:

* Reapply for a new driver license.
* Pay a $55 reissue fee.

If financial responsibility is not maintained:
•Registration of the vehicle will be subject to suspension (VC §4000.38). DMV will begin the process to suspend the registration of a vehicle if:
—DMV is notified that a liability policy has been cancelled and a replacement policy is not provided within 45 days.
—The registered owner fails to provide evidence of insurance within 30 days of a registration card being issued on a newly acquired vehicle.
—The registration is obtained by providing false evidence of insurance.
•The operator’s driving privilege may be suspended (VC §16070)—If the vehicle is involved in an accident and evidence of financial responsibility cannot be provided, the operator may lose his/her driving privilege for up to one year.
•The operator may be cited (VC §§16028b, 16028c)—Failure to provide evidence of financial responsibility when requested by a peace officer may result in a citation. DMV cannot clear or sign citations relating to financial responsibility. Only a court can clear or sign these citations.
•The vehicle may be impounded (VC §16029c)—Failure to provide evidence of financial responsibility may result in the vehicle being impounded, in addition to any fines.
•The operator/owner may be personally liable for damages—If the operator contributes to the cause of an accident and cannot provide evidence of financial responsibility, the operator and/or the owner may be forced to compensate the other party for any injuries or damages.

Proof of financial responsibility may be met by making a $35,000 cash deposit with the department or by filing a $35,000 surety bond. Proof may also be filed by a department-approved self insurer on behalf of an employee, to permit driving vehicles owned by the self-insurer within the scope of the person’s employment. A bond must be obtained from a surety company authorized to do business in California.

The usual method of showing proof of financial responsibility is to provide a California Insurance
Proof Certificate (form SR-22/SR-1P) from an insurance company authorized to do business in
California. The types of coverage on the form SR-22/SR-1P are listed below:

SR-22: A motor vehicle liability policy may be provided to cover only vehicles registered in your
name (owner’s policy), only vehicles you do not own (operator’s policy), or all vehicles whether
you own them or not (broad coverage). This certificate is acceptable for any DMV actions
requiring proof of financial responsibility.

SR-1P: An automobile liability policy or a liability policy for vehicles with fewer than four wheels.
This certificate is acceptable after an accident without insurance, for negligent operator sanctions
per §12810.5 VC, for an application by a minor requiring proof (§17705 VC), or for a nonresident
minor’s certificate (§12504 VC).

To obtain a California Insurance Proof Certificate, contact an insurance agent or broker. Do
not submit a copy of your policy or your insurance application, as it cannot be accepted in
place of the California Insurance Proof Certificate. If necessary, persons unable to obtain this
insurance coverage through their regular insurance company may have any insurance agent

Through the provisions of the Safety and Financial Responsibility Law, motorists are held responsible for accident damages both administratively and through the court system. In many cases, drivers are required to file proof of financial responsibility for periods ranging from one to three years in the form of SR-22 Insurance policies (commonly know as high-risk insurance). The Secretary of State’s S&FR section monitors SR-22s for cancellation and expiration.

This requirement, enhanced in 1998 and 1999, forces the irresponsible party to carry insurance-thereby preventing future uninsured crashes.

The S&FR law is ultimately an enforcement mechanism for Illinois’ Mandatory Insurance Law. While all drivers are required to carry liability insurance, S&FR deals specifically with violators. We help victims of uninsured crashes obtain restitution from irresponsible motorists by suspending license and registration privileges.

Under the S&FR law, drivers are held responsible once an accident occurs, and, through the SR-22 insurance policy, future crashes are prevented.

Effective Jan. 1, 1958

• Established a .15 percent BAC limit at which a driver is presumed to be under the influence of alcohol.

• Lowered the illegal BAC limit from .15 to .10 percent.

• Required the installation of a Breath Alcohol Ignition Interlock Device (BAIID) in the vehicle of any individual with two or more DUI incidents. Provided that a monthly fee be charged for the maintenance of the BAIID device and money generated from this fee be deposited into the Secretary of State’s DUI Administration Fund.
• Set a $50 fee for any individual requesting a formal hearing with the Office of the Secretary of State for the purposes of asking for restricted driving relief or reinstatement of driving privileges.

• Provided for an additional $100 fine for any person convicted of driving under the influence. This money is deposited into the Trauma Center Fund for distribution to Illinois hospitals and trauma centers.
• Provided that a person sentenced to reckless homicide shall not be permitted to drive until 24 months after the date of his or her release from prison. This 24-month period does not commence until the expiration of any period of mandatory supervised release or parole.

• Provided for the seizure and forfeiture of a person’s vehicle who is convicted of driving on a revoked or suspended driver’s license, if the suspension or revocation was the result of a conviction for DUI, leaving the scene of a personal injury accident, reckless homicide, or for a statutory summary suspension related to the use of alcohol, drugs or intoxicating compounds.

• Requires local liquor commissioners to report to the Secretary of State any conviction of a person under age 21 that purchases, accepts, possesses or consumes alcoholic liquor. A violation results in a one-year suspension or revocation of driving privileges.

• Provides that operating a watercraft or snowmobile under the influence of intoxicating compounds is prohibited.

• Provides that reckless driving in a construction or maintenance zone resulting in a death is reckless homicide, a Class 2 felony and, if a defendent is sentenced to imprisonment, he or she shall be sentenced to three to 14 years. If the offense involves the death of two or more persons as part of a single course of conduct, and, if sentenced to imprisonment, a defendant shall be sentenced to 6 to 28 years.

• Made leaving the scene of an accident a Class 4 felony with possible imprisonment of one to three years in prison. Requires a driver who leaves the scene of an accident to report the accident to local law enforcement within 30 minutes of the time of the accident (rather than one hour).

• If a person is convicted in another state of an offense similar to the Illinois reckless homicide statute, that person may not be granted full driving privileges for two years from the date on which the person’s driving privileges were revoked or suspended, or within 24 months of the person being released from a prison term for commission of the offense.
• A person who commits the offense of driving under the influence of alcohol, drugs, intoxicating compounds, or any combination of them is guilty of aggravated DUI if the person previously had been convicted in another state of an offense similar to reckless homicide and the person’s intoxication was an element of the offense.

An ignition interlock device (IID) is a device slightly larger than a cell phone that is wired to your vehicle’s ignition. The device can be installed in a vehicle while you wait and after installation, it requires your breath sample before the engine will start. If the IID detects alcohol on your breath, the engine will not start. As you drive, you are periodically required to provide breath samples to ensure the continued absence of alcohol in your system.

Yes. The International Council on Alcohol, Drugs and Traffic Safety maintains that IIDs, when combined with a comprehensive monitoring and service program, lead to a 40-95% reduction in the rate of repeat drunk driving offenses among offenders as long as the IID remains on the vehicle.
